Within the general "dialogue" among international tribunals and bodies, it is possible to observe the effects of forms of mutual interaction and influence between the European Court of Human Rights and the Inter-American Court of Human Rights. They find a fertile soil in the strong possibility of being assimilated in many points both of the fundamental "catalogue" of the protected rights and of the procedural guarantee instruments, provided by the American Convention on Human Rights and by the European Convention for the Protection of Human Rights and Fundamental Freedoms: two conventions embedded in juridical and meta-juridical contexts which are also very different from each other.
Does the "circulation" of judgments and of jurisprudence values between the European Court of Human Rights and the Inter-American Court of Human Rights cause phenomena of "cross-fertilization" or, at least, of trans-regional judicial dialogue?
This study aims at examining to what extent has the case law of the European Court of Human Rights on the right to a fair trial influenced the case law of the Inter-American Court of Human Rights (and vice versa). Within this context, it also considers how these Courts perform their task of guaranteeing the correct interpretation and application of the conventionally granted rights but also of fostering the evolution of jurisprudence approaches through the "circulation" of their respective case law.
